In no event shall miadishes’ total cumulative liability to you for any claim arising under these Terms exceed the amount you have actually paid to miadishes, if any, in the twelve (12) months preceding the claim. Arbitration. If the dispute cannot be resolved through negotiation within thirty (30) days, the parties agree to submit the dispute to binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. The arbitration shall be conducted in English in New York, New York, United States. The arbitrator’s award shall be final and binding, and judgment on the award may be entered in any court having jurisdiction.
Waiver of Class Actions. You agree that any arbitration or legal proceeding shall be limited to the individual party seeking relief and shall not be a class action or any other representative proceeding.
